DEATH 2 DATING

TERMS OF SERVICE

Effective Date: September 1st 2026

Last Updated: September 1st 2026

These Terms of Service (“Terms”) are a legally binding agreement between you and AnteSocial LLC, doing business as Death 2 Dating (“Death 2 Dating,” “D2D,” “we,” “us,” or “our”). These Terms govern your access to and use of the Death 2 Dating website, mobile applications, messaging system, payment features, and related services collectively referred to as the “Service.” Death 2 Dating provides its core dating and matching features for free. Sending messages is a paid service. Message recipients may become eligible to earn money when they read or reply to qualifying paid messages, subject to these Terms. By creating an account, clicking to accept these Terms, purchasing or sending a message, or otherwise using the Service, you agree to these Terms, our Privacy Policy, Community Guidelines, Safety Standards, and any additional terms displayed when you use a particular feature.

Section 22 contains a binding arbitration agreement and class-action waiver. Please read it carefully.

1. ELIGIBILITY You may use Death 2 Dating only if:

  1. You are at least 18 years old and have reached the legal age of majority where you live;
  2. You have the legal capacity to enter into a binding agreement;
  3. You are not prohibited from using the Service under applicable law;
  4. You are not required to register as a sex offender in any jurisdiction;
  5. You have not previously been suspended or removed from Death 2 Dating unless we have given you written permission to return; and
  6. You agree to comply with these Terms and all applicable laws.

Death 2 Dating is strictly for adults. No person under 18 may create an account, access the Service, communicate with users, or appear in profile content. By using the Service, you represent that all eligibility statements above are true.

2. THE DEATH 2 DATING SERVICE

2.1 Free Dating Features Death 2 Dating’s core dating service is free. Subject to feature availability, users may create a profile, browse or discover profiles, indicate interest, match with other users, and use other dating-related features that are identified as free. No subscription is required to use the core dating and matching service. Death 2 Dating may offer optional premium tools or promotional features in the future. Any price will be clearly disclosed before you agree to purchase such a feature.

2.2 Paid Messaging Sending a message through Death 2 Dating is a paid service unless the application expressly states that a particular message is free. Before you send a paid message, the Service will display:

  1. The message price;
  2. Any applicable taxes or transaction charges;
  3. Whether different portions of the price relate to reading and replying;
  4. The applicable reply period, where relevant; and
  5. Any refund or credit that may apply if the recipient does not reply. The price displayed and accepted immediately before the message is sent will control that transaction. A higher fee may apply to certain messages, including messages sent to users who have not matched with the sender. Any higher fee will be shown before the message is sent.

2.3 What a Message Payment Purchases A message payment purchases access to Death 2 Dating’s messaging functionality only. It does not purchase or guarantee:

• A response;

• Romantic interest;

• Continued communication;

• A date or in-person meeting;

• Affection, companionship, or exclusivity;

• Sexual content or activity; or

• Any service from another user.

No user is ever obligated to read, reply to, continue, or accept a message.

3. ACCOUNTS AND PROFILES

You must provide accurate, current, and complete information when creating and maintaining your account. You may not:

1. Create a false or misleading identity;

2. Impersonate another person;

3. Use another person’s photographs without permission;

4. Misrepresent your age, name, location, relationship status, appearance, intentions, or other material information;

5. Create more than one personal account without our permission;

6. sell, rent, transfer, or share your account;

7. Allow another person to use your account; or

8. Create an account primarily for advertising, solicitation, research, surveillance, or commercial activity.

Your profile photographs must accurately represent you. You may not use a synthetic, AI-generated, heavily manipulated, stolen, or misleading photograph in a manner that causes another user to believe it is an authentic photograph of you. You are responsible for protecting your login credentials and for all activity occurring through your account. Notify us promptly at admin@antesocial.com if you believe your account has been accessed without authorization.

4. IDENTITY AND BACKGROUND-SCREENING NOTICE

Unless Death 2 Dating expressly states otherwise in a separate written notice, Death 2 Dating does not conduct comprehensive criminal background checks on every user and does not independently verify every statement made in a profile. A verification badge or identity-verification feature, when available, may confirm only limited information. Verification does not mean that:

• A person is safe;

• A person has no criminal history;

• All profile information is accurate;

• The verified person controls every message from the account; or

• Death 2 Dating endorses or recommends that person.

You are responsible for using reasonable judgment and taking appropriate safety precautions when communicating with or meeting another user.

5. MESSAGE FEES, READ AND REPLY EARNINGS

5.1 Message Earnings A recipient of a qualifying paid message may become eligible to receive a portion of the message fee when the recipient:

1. Personally and genuinely reads the message; and/or

2. Personally provides a qualifying reply within the applicable reply period.

Amounts potentially payable to a recipient are referred to as “Message Earnings.” Message Earnings may include a read portion and a reply portion. The amount available for each action will be disclosed in the Service or determined under the applicable message-pricing rules in effect when the message is sent.

5.2 Qualifying Reads and Replies Death 2 Dating may use technical, behavioral, fraud-prevention, and quality-control measures to determine whether a read or reply qualifies for Message Earnings. A qualifying reply must be made in good faith and must be reasonably responsive to the conversation. The following do not qualify:

• Automated or bot-generated activity not authorized by D2D;

• Empty, meaningless, repetitive, or copied responses sent primarily to generate earnings;

• Coordinated messaging between related or cooperating accounts;

• Messages sent to yourself through another account;

• Artificially generated reads or replies;

• Misleading expressions of romantic interest made primarily to encourage additional paid messages;

• Messages generated through fraud, coercion, harassment, or prohibited content; or

• Activity that otherwise violates these Terms.

Death 2 Dating may reject, reverse, or withhold Message Earnings associated with nonqualifying activity.

5.3 Conditional Status of Earnings Message Earnings are conditional and do not become payable until:

1. The qualifying action has been verified;

2. The underlying payment has cleared;

3. Any applicable refund or reply period has expired;

4. Fraud, safety, and chargeback reviews have been completed; and

5. Any applicable payout threshold and identity-verification requirements have been satisfied.

A displayed balance may include pending amounts and does not necessarily represent money that is immediately available for withdrawal. Message Earnings are not wages, salary, interest, securities, deposits, or guaranteed compensation. Using Death 2 Dating does not create an employment, agency, partnership, fiduciary, or joint-venture relationship.

5.4 Payouts To receive a payout, you may be required to:

• Verify your identity and age;

• Provide accurate tax information;

• Complete payment-provider verification;

• Use a payout method in your own name;

• Satisfy a minimum payout threshold; and

• Pass fraud, safety, sanctions, and chargeback reviews.

Payout methods may include ACH, PayPal, an eligible debit card, or another method made available through the Service. Third-party payment providers may impose separate terms, processing times, eligibility requirements, and fees. You are responsible for all taxes and Fees arising from your Message Earnings. We may report payments to tax authorities and withhold amounts where required by law.

5.5 No-Reply Credits or Refunds Where the Service states that a portion of a message fee is reserved for a reply, that portion may be returned or credited to the sender if the recipient does not provide a qualifying reply during the displayed reply period. The read portion of a fee is generally nonrefundable after a qualifying read has occurred. The exact amount, time limit, and conditions displayed before the message is sent will control.

5.6 Expired Conversation Windows A new message fee may be required after a conversation or response window expires, including after an extended period of inactivity. Any new fee will be displayed before the message is sent.

5.7 Refunds and Chargebacks Except for a refund expressly described in the Service, a technical billing error, or a refund required by law, message purchases are final. You may not initiate a false or abusive chargeback. A chargeback may result in:

• Suspension of your account;

• Reversal of related Message Earnings;

• An offset against future payouts;

• Recovery of payment-processing costs; and

• Permanent removal from the Service.

6. FAIR AND HONEST PARTICIPATION

Death 2 Dating’s paid-message system is intended to compensate genuine participation, not deceptive or artificial activity. You may not:

1. Pretend to have romantic interest solely to generate additional messages or earnings;

2. Deliberately prolong a conversation solely for financial gain;

3. Encourage a person to send repeated paid messages through false promises;

4. Operate multiple accounts to generate earnings;

5. Coordinate with another person to exchange paid messages for the purpose of farming revenue;

6. Use a bot, script, automation tool, click farm, or third-party service to create activity;

7. Circumvent payment rules or direct another user to avoid applicable platform charges;

8. Manipulate read receipts, reply events, location data, or engagement metrics;

9. Sell or transfer an account or Message Earnings; or

10. Use the Service as an investment, employment, or guaranteed-income opportunity.

Violation of this Section may result in reversal or forfeiture of associated earnings, suspension, or termination.

7. ZERO-TOLERANCE ADULT-ORIENTED CONTENT AND ACTIVITIES

7.1 Adults-Only Does Not Mean Adult Content Death 2 Dating is an adults-only dating service. It is not a pornography platform, adult-entertainment service, escort service, sexual-services marketplace, or platform for selling sexual content. Adult-oriented content and activities are prohibited in profiles, photographs, videos, audio, usernames, biographies, prompts, public posts, private messages, links, QR codes, and all other areas of the Service.

7.2 Prohibited Adult-Oriented Material You may not upload, send, request, offer, distribute, promote, or link to:

1. Nudity or partially obscured nudity;

2. Images or videos displaying or emphasizing genitals, breasts, buttocks, or intimate areas;

3. Pornography or sexually explicit content;

4. Actual or simulated sexual acts;

5. Masturbation, fetish, or sexually graphic material;

6. Sexually explicit animation, illustrations, or AI-generated content;

7. Boudoir, lingerie, or sexually suggestive material primarily intended to arouse;

8. Unsolicited sexual messages or descriptions;

9. Requests for nude or sexually explicit images;

10. Nonconsensual intimate imagery;

11. Sexually altered photographs or sexual deepfakes;

12. Voyeuristic or secretly recorded intimate material;

13. Links, handles, advertisements, or invitations directing users to adult-content websites or services; or

14. Any material that Death 2 Dating reasonably determines is pornographic, sexually exploitative, or inappropriate for the Service.

7.3 Prohibited Adult-Oriented Activities You may not use Death 2 Dating to offer, seek, arrange, advertise, or promote:

1. Prostitution or commercial sexual activity;

2. Escort services;

3. Paid sexual encounters;

4. Sugar dating or arrangements involving compensation in exchange for intimacy;

5. Paid companionship intended as a disguised sexual service;

6. Pornographic performances or productions;

7. Webcam, phone-sex, or adult livestream services;

8. The sale of nude, explicit, fetish, or adult content;

9. Human trafficking or sexual exploitation;

10. Sexual coercion or blackmail;

11. Sexual activity involving a person who cannot or does not consent; or

12. Any illegal or commercial adult-oriented activity.

Non-graphic, respectful discussion of relationship expectations, boundaries, compatibility, or sexual health is not automatically prohibited, provided it is lawful, consensual, noncommercial, and does not include explicit content.

7.4 Mandatory Consequences A suspected violation of this Section may result in immediate temporary suspension, content removal, and a hold on all payouts while we investigate. A confirmed violation of this Section will result in immediate account suspension and may result in permanent termination. To the fullest extent permitted by law, the violating user will automatically forfeit all pending, accrued-but-unpaid, and unwithdrawn Message Earnings, including all message read and reply revenue held in the user’s account. This forfeiture applies whether the violation occurs in a public profile or a private message. We may also:

• Remove the prohibited material;

• Cancel pending transactions;

• Reverse related credits;

• Offset refunds, fraud losses, or chargebacks;

• Restrict the user from creating another account;

• Preserve relevant evidence;

• Notify payment providers;

• Report the activity to law enforcement or other appropriate authorities; and

• Take any other action reasonably necessary to protect users and the Service.

Amounts that applicable law does not permit us to forfeit will be handled as legally required. If an investigation determines that no violation occurred, any improperly applied hold or forfeiture will be reversed.

8. CHILD SAFETY AND EXPLOITATION

Death 2 Dating has zero tolerance for child sexual abuse, exploitation, grooming, trafficking, or content involving minors. You may not:

1. Use the Service if you are under 18;

2. knowingly communicate romantically or sexually with a person under 18;

3. Upload any photograph or content depicting a minor;

4. Upload sexual content created when any depicted person was under 18, even if that person is now an adult;

5. Request, possess, transmit, or distribute child sexual abuse material;

6. Engage in grooming, enticement, age-play involving minors, or sexual roleplay as a minor;

7. Misrepresent a minor as an adult; or

8. Use the Service to facilitate child abuse, exploitation, trafficking, or an unlawful meeting.

We may immediately suspend accounts, preserve account information and content, and report suspected exploitation to the National Center for Missing & Exploited Children, law enforcement, payment providers, or other appropriate authorities. These violations are not eligible for ordinary account reinstatement.

9. HARASSMENT, CONSENT, AND PERSONAL SAFETY

You must respect the rights, safety, boundaries, and decisions of other users. You may not:

• Threaten, intimidate, stalk, harass, bully, shame, or coerce another person;

• Continue contacting someone who has asked you to stop;

• Evade a block by creating another account;

• Pressure anyone to meet, reply, share contact information, or move off-platform;

• Send unwanted sexual communications;

• Use threats of self-harm to manipulate another person;

• Encourage suicide, self-harm, violence, or dangerous behavior;

• Share another person’s private information without permission;

• Discriminate against, dehumanize, or threaten someone based on a protected characteristic;

• Blackmail, extort, or threaten to expose private information or images; or

• Record or distribute private conversations or intimate activity without all required consent.

Consent must be voluntary, informed, specific, and ongoing. Consent to communicate, meet, kiss, or engage in one activity is not consent to another activity. Consent may be withdrawn at any time.

10. FRAUD, SCAMS, AND FINANCIAL SOLICITATION

You may not use Death 2 Dating to:

1. Ask users for money, loans, gifts, gift cards, cryptocurrency, financial assistance, or investments;

2. Promote cryptocurrency, securities, investment opportunities, gambling, or get-rich-quick programs;

3. Obtain bank, credit-card, payment-account, Social Security, login, or identity information;

4. Engage in phishing, identity theft, romance scams, advance-fee schemes, or financial fraud;

5. Misrepresent an emergency or hardship to obtain money;

6. Launder money or transfer funds for another person;

7. Recruit users for multilevel marketing or commercial schemes; or

8. Direct users to suspicious third-party payment systems.

Do not send money or financial information to someone you meet through the Service. Report suspected scams immediately.

11. OTHER PROHIBITED CONDUCT

You may not:

• Engage in illegal conduct;

• Sell or promote illegal drugs, controlled substances, weapons, or stolen goods;

• Promote violence, terrorism, or criminal organizations;

• Upload malware, malicious code, or harmful files;

• Interfere with the security or operation of the Service;

• Scrape, harvest, copy, reverse engineer, or extract user information without authorization;

• Use user information for advertising, surveillance, research, or data brokerage;

• Send spam, mass messages, or unauthorized advertisements;

• Infringe copyrights, trademarks, privacy rights, or other legal rights;

• Submit false reports against other users;

• Abuse reporting or blocking systems;

• Circumvent an account restriction or suspension; or

• Help another person violate these Terms. 1

2. AI, AUTOMATION, AND VIRTUAL PROFILES

Death 2 Dating may use artificial intelligence and automated systems for recommendations, profile assistance, customer support, fraud detection, content moderation, and safety. Any conversational profile controlled by Death 2 Dating that represents an AI-generated, virtual, fictional, promotional, or staff-managed persona must be clearly labeled before a user is charged to communicate with it. A labeled virtual or AI profile does not represent a real person available for an offline romantic relationship unless the Service expressly states otherwise. Users may not:

1. Operate an undisclosed bot or automated profile;

2. Use AI to impersonate another person;

3. Present an AI-generated person as their real identity;

4. Automate reads or replies to generate Message Earnings;

5. Use AI to create fraudulent, harassing, sexual, or misleading messages; or

6. Create sexual deepfakes or nonconsensual synthetic content.

You remain responsible for content created with AI assistance and must review it before posting or sending it.

13. USER CONTENT

“User Content” includes photographs, profile information, prompts, messages, videos, audio, feedback, and other material you submit through the Service. You retain ownership of your User Content. By submitting it, you grant Death 2 Dating a worldwide, nonexclusive, royalty-free, sublicensable license to host, store, reproduce, format, display, transmit, and moderate the content as reasonably necessary to:

• Operate and improve the Service;

• Display your profile to other users;

• Deliver messages;

• Prevent fraud and abuse;

• Enforce these Terms;

• Respond to reports;

• Comply with legal obligations; and

• Protect users and the public.

We will not use your private messages or profile images in an external advertising campaign without separate permission, except where legally permitted for safety, enforcement, or legal purposes. You represent that:

1. You own or have permission to submit the content;

2. The content is accurate and not misleading;

3. Every identifiable adult appearing in the content consented to its use;

4. No minor appears in the content;

5. The content does not violate another person’s privacy or intellectual-property rights; and

6. The content complies with these Terms.

We may remove or restrict content at any time when we reasonably believe it violates these Terms, creates a safety risk, infringes legal rights, or may harm Death 2 Dating or its users.

14. SAFETY NOTICE FOR ONLINE AND OFFLINE INTERACTIONS

Death 2 Dating cannot control the behavior of users online or offline. Use caution and common sense. You should:

1. Keep early communications within the Service;

2. Avoid sharing your home address, workplace, financial information, passwords, or identifying documents;

3. Never send money, gift cards, cryptocurrency, banking information, or valuables to an online romantic interest;

4. Consider video chatting before meeting;

5. Meet for the first time in a populated public place;

6. Tell a trusted person where you are going and when you expect to return;

7. Arrange your own transportation;

8. Keep your phone charged and accessible;

9. Avoid becoming impaired by alcohol or drugs;

10. Leave immediately if you feel pressured, unsafe, or uncomfortable; and

11. Report suspicious or dangerous behavior through the Service.

Death 2 Dating is not an emergency-response service. If you or another person faces an immediate threat, contact 911 or the appropriate emergency service where you are located. FTC safety guidance similarly warns users not to send money or gifts to an online love interest and to report suspected romance scams to both the platform and appropriate authorities.

15. REPORTING, BLOCKING, AND INVESTIGATIONS

Users may report or block another account through the Service or by contacting admin@antesocial.com. When submitting a report, provide accurate information and any relevant screenshots, account names, dates, or message details. Do not submit knowingly false or retaliatory reports. We may:

• Review account and message activity;

• Use automated safety tools;

• Request additional information;

• Temporarily restrict communication or payouts;

• Remove content;

• Warn users;

• Suspend or terminate accounts;

• Preserve relevant records;

• Notify affected users where appropriate; and

• Cooperate with law enforcement, courts, regulators, safety organizations, or payment providers.

We are not required to disclose confidential safety methods, another user’s private information, or the complete outcome of an investigation. Federal law imposes reporting obligations on covered providers that obtain actual knowledge of specified apparent child sexual exploitation, and NCMEC’s CyberTipline serves as the United States’ centralized reporting system for online child exploitation.

16. ENFORCEMENT AND APPEALS

We may immediately suspend or restrict an account when we reasonably believe that:

• These Terms have been violated;

• A user presents a risk to another person;

• Fraud or payment abuse has occurred;

• Identity or age information is false;

• A report requires investigation;

• Continued access may expose D2D or another person to legal or safety risk; or

• Suspension is required by law or a payment provider.

Except in cases involving child exploitation, credible threats, fraud, evasion, or other circumstances where review would create additional risk, a user may appeal an enforcement decision within 30 days by contacting admin@antesocial.com An appeal should explain why the decision was incorrect and include supporting information. We may affirm, modify, or reverse the decision. Suspension may remain in effect during review.

17. INTELLECTUAL PROPERTY

Death 2 Dating and its licensors own the Service, software, designs, trademarks, logos, interface, text, graphics, and other proprietary materials, excluding User Content. We grant you a limited, personal, revocable, nonexclusive, nontransferable license to use the Service for lawful personal dating purposes. You may not copy, modify, distribute, sell, sublicense, reverse engineer, or commercially exploit any portion of the Service without written permission.

Copyright complaints should be sent to:

DMCA Agent: DMCA REQUESTS

Email: admin@antesocial.com

Address: 408 E 4th Street, Suite 300 Bridgeport PA,19405

A copyright notice should identify the protected work, the allegedly infringing material, your contact information, a statement of good-faith belief, a statement made under penalty of perjury, and your physical or electronic signature.

18. PRIVACY AND COMMUNICATIONS

Our collection, use, retention, and disclosure of personal information are described in the Death 2 Dating Privacy Policy. Messages and other activity may be processed by automated systems and, where reasonably necessary, reviewed by authorized personnel for fraud prevention, safety, moderation, customer support, and legal compliance. By providing an email address or telephone number, you consent to receive transactional communications concerning your account, security, purchases, messages, payouts, and these Terms. Marketing communications will be sent only as permitted by law and applicable consent. You may opt out of marketing messages without closing your account, but you may continue to receive necessary transactional communications.

19. THIRD-PARTY SERVICES

The Service may rely on payment processors, payout providers, hosting companies, app stores, identity-verification services, mapping tools, and other third parties. Your use of a third-party service may be governed by that provider’s terms and privacy practices. Death 2 Dating is not responsible for a third party’s independent acts, outages, eligibility decisions, fees, or processing times, except to the extent required by law.

20. ACCOUNT CLOSURE AND TERMINATION

You may close your account through the available account settings or by contacting support. Death 2 Dating may suspend, restrict, or terminate your account for violation of these Terms, safety concerns, fraud, payment disputes, prolonged inactivity, legal requirements, or discontinuation of the Service. Upon termination:

1. Your right to use the Service ends;

2. Unused, nonrefundable messaging credits may expire except where law requires otherwise;

3. Invalid, fraudulent, prohibited, or forfeited Message Earnings will not be paid;

4. Valid approved earnings will be handled under these Terms and applicable law;

5. We may retain information as described in the Privacy Policy; and

6. Provisions intended to survive termination will remain in effect.

Sections concerning payment obligations, prohibited conduct, intellectual property, disclaimers, liability, disputes, and indemnification survive termination.

21. DISCLAIMERS AND LIMITATION OF LIABILITY

21.1 No Guarantee Death 2 Dating does not guarantee:

• Matches, messages, reads, replies, dates, relationships, or earnings;

• The identity, intentions, honesty, compatibility, location, or conduct of any user;

• That a user will remain available;

• That the Service will be uninterrupted or error-free;

• That every violation will be detected; or

• That use of the Service will be safe or successful.

21.2 Service Provided “As Is” To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, or uninterrupted operation. Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.

21.3 User Conduct To the fullest extent permitted by law, Death 2 Dating is not responsible for the conduct of a user, whether occurring through the Service or during an offline interaction.

21.4 Limitation of Liability To the fullest extent permitted by law, Death 2 Dating and its owners, affiliates, officers, directors, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, emotional distress, loss of opportunity, or reputational harm. Our total liability arising from or relating to the Service will not exceed the greater of:

1. The amount you paid directly to Death 2 Dating during the 12 months before the event giving rise to the claim; or

2. One hundred dollars.

This limitation does not apply to liability that applicable law does not permit us to limit, including liability arising from our fraud, willful misconduct, or gross negligence where such exclusion is prohibited.

22. DISPUTE RESOLUTION, ARBITRATION, AND CLASS-ACTION WAIVER

22.1 Informal Resolution Before filing a lawsuit or arbitration, you and Death 2 Dating agree to provide written notice of the dispute and attempt in good faith to resolve it for at least 30 days. A notice to Death 2 Dating must be sent to 408 E 4th Street, Suite 300 Bridgeport PA 19450 and must describe the claimant, account, facts, requested relief, and contact information.

22.2 Individual Arbitration Except for disputes eligible for small-claims court and requests for temporary injunctive relief involving safety, unauthorized access, or intellectual property, disputes arising from these Terms or the Service will be resolved through binding individual arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules. The current AAA consumer framework provides rules and fee procedures for disputes between consumers and businesses.

22.3 No Class Proceedings To the fullest extent permitted by law, disputes must be brought individually and not as a class action, collective action, private-attorney-general action, or representative proceeding. Neither party may participate as a class representative or class member in a dispute covered by the arbitration agreement.

22.4 Arbitration Opt-Out You may opt out of arbitration by sending written notice to ARBITRATION OPT-OUT 408 E 4th Street Suite 300, Bridgeport PA 19405 within 30 days after first accepting these Terms. Your notice must include your name, account email, and a clear statement that you are opting out of the arbitration agreement. Opting out will not affect your ability to use the Service.

22.5 Governing Law These Terms are governed by the laws of the State of Pennsylvania, without regard to conflict-of-law rules, except where another jurisdiction’s nonwaivable consumer-protection law applies. If the arbitration agreement is found inapplicable to a particular dispute, the parties consent to the exclusive jurisdiction of the state and federal courts located in Philadelphia, Pennsylvania, except for an eligible small-claims matter.

23. INDEMNIFICATION

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Death 2 Dating and its affiliates, officers, directors, employees, contractors, and agents from claims, damages, losses, liabilities, and reasonable legal expenses arising from:

1. Your User Content;

2. Your conduct toward another person;

3. Your misuse of the Service;

4. Your violation of these Terms;

5. Your violation of law; or

6. Your infringement of another person’s rights.

This obligation does not apply to the extent a claim was caused by Death 2 Dating’s own unlawful conduct.

24. CHANGES TO THE SERVICE OR TERMS

We may modify the Service, pricing, features, safety systems, or these Terms. A pricing change will apply prospectively and will not alter a message transaction after you have accepted its displayed price. For material changes to these Terms, we will provide reasonable notice through the Service, by email, or through another appropriate method. Continued use after the effective date of updated Terms constitutes acceptance, except where the law requires additional consent.

25. GENERAL TERMS

These Terms, the Privacy Policy, Community Guidelines, Safety Standards, and transaction-specific disclosures constitute the complete agreement between you and Death 2 Dating concerning the Service. If a provision is held unenforceable, the remaining provisions remain effective, and the unenforceable provision will be modified only to the minimum extent necessary. Our failure to enforce a provision is not a waiver. You may not assign your account or rights under these Terms. We may assign these Terms in connection with a merger, financing, reorganization, sale of assets, or transfer of the Service. These Terms do not create third-party beneficiary rights. Section headings are for convenience and do not limit the meaning of a provision.
